Please read these Terms of Service ("Terms") carefully before using the RecordFlower platform at https://recordflower.com (the "Service") operated by RecordFlower V.O.F. ("RecordFlower", "we", "us", or "our").
By creating an account and using the Service, you ("the Seller") agree to be bound by these Terms. The Service is intended exclusively for business users — individuals and companies acting in the course of their trade, business, or profession.
RecordFlower is a technical platform that enables Discogs sellers to build and operate their own branded webshop, powered by their Discogs inventory. RecordFlower provides the software infrastructure: storefront hosting, Discogs inventory sync, checkout, and order management tools.
RecordFlower is solely a technical service provider. RecordFlower is not a party to any purchase agreement between the Seller and the Seller's end customers. All product listings, sales, fulfilment, payments, returns, and customer relationships are the sole responsibility of the Seller. RecordFlower accepts no responsibility or liability for any transaction conducted through a Seller's storefront.
You represent that all information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access. You must be at least 18 years of age and authorised to enter into legally binding contracts.
The Service connects to your Discogs account via OAuth 1.0a. By authorising this connection, you grant RecordFlower permission to access your Discogs inventory, listings, and related data on your behalf. You remain the account holder and the party bound by the Discogs API Terms of Use ("Discogs ToU") with respect to all API usage performed through RecordFlower.
3.1 — Your Discogs account and compliance
You represent and warrant that: (a) you hold a valid, active Discogs account in good standing; (b) you have accepted and will continue to comply with the Discogs ToU and all Discogs policies; and (c) your use of the RecordFlower Service does not cause RecordFlower or yourself to violate any Discogs policy. You are solely responsible for your Discogs account, its credentials, and all activity conducted through it via the Service.
If Discogs suspends, restricts, or terminates your Discogs account or API access — for any reason, including a violation of the Discogs ToU — RecordFlower may immediately suspend your access to all Discogs-dependent features of the Service. RecordFlower accepts no responsibility or liability whatsoever for any consequences arising from such a suspension or termination by Discogs, including but not limited to: loss of storefront availability, loss of inventory data, loss of sales or revenue, reputational damage, or any other direct or indirect loss suffered by you or your customers. Such a suspension by RecordFlower does not constitute a breach of these Terms and does not entitle you to any refund, compensation, or damages.
3.2 — Data access scope
RecordFlower accesses only the Discogs data necessary to provide the Service: your inventory listings, release catalogue data, and listing availability. RecordFlower acts strictly as a technical agent executing API requests on your behalf, using your OAuth token. RecordFlower does not transfer your Discogs data to any third party beyond what is necessary to display it within your own storefront.
3.3 — Required Discogs attribution
The Discogs ToU requires that the following notices be displayed on any application using the Discogs API. RecordFlower includes these notices on storefront pages that display Discogs data. You may not configure your storefront in a way that removes or obscures these required attribution notices:
3.4 — Data freshness
The Discogs ToU prohibits displaying data more than six (6) hours older than the information on Discogs' own properties. You are responsible for ensuring your sync schedule is set frequently enough to comply with this requirement. RecordFlower accepts no liability for non-compliance arising from infrequent sync settings or Discogs API unavailability.
3.5 — API availability and termination by Discogs
Discogs may modify, restrict, or discontinue access to its API at any time and without notice, at its sole discretion. RecordFlower has no control over and accepts no liability for any interruption, degradation, or termination of Discogs API access, including any resulting impact on your storefront's availability, inventory data, or sales. Such a suspension does not constitute a breach of these Terms and does not entitle you to a refund, except where required by mandatory applicable law.
3.6 — No affiliation with Discogs
RecordFlower V.O.F. is an independent software provider. RecordFlower is not affiliated with, sponsored by, endorsed by, or in any way officially connected with Zink Media, LLC (d/b/a Discogs). "Discogs" is a registered trademark of Zink Media, LLC.
3.7 — Indemnification for Discogs ToU violations
You agree to indemnify, defend, and hold harmless RecordFlower V.O.F. and its members, employees, and agents from and against any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from: (a) your violation of the Discogs ToU or any Discogs policy; (b) any claim by Discogs against RecordFlower resulting from your use of the Service; or (c) any misuse of Discogs data accessed through your account via the Service.
Access to the Service is provided on a subscription basis, billed in advance on a monthly or annual cycle. Your subscription will automatically renew unless cancelled before the renewal date. You authorise RecordFlower to charge the applicable fees to your payment method on file. If payment fails, you must remedy the failure within 14 days. Subscriptions may be cancelled at any time via the dashboard; no partial refunds are provided for unused time, except where required by applicable law.
RecordFlower may offer a free trial period. If you do not cancel before the end of the trial, you will be charged the applicable subscription fee. RecordFlower reserves the right to modify or cancel free trial offers at any time.
RecordFlower will provide at least 30 days' written notice (by email) before any fee change takes effect. Continued use after the effective date constitutes acceptance of the revised fees.
As a Seller, you are solely responsible for:
You agree not to use the Service to list or sell counterfeit, stolen, or illegal goods; engage in fraud; reverse-engineer or disrupt the platform; or violate applicable laws. RecordFlower reserves the right to suspend or terminate accounts involved in abusive or illegal activity.
The Service and its software, design, and branding are the exclusive property of RecordFlower V.O.F. and its licensors, protected by Dutch and EU intellectual property law. You are granted a limited, non-exclusive, non-transferable licence to use the Service solely for the purpose of operating your webshop. Content you upload remains your property; you grant RecordFlower a limited licence to host and display it to provide the Service.
Either party may terminate these Terms at any time. RecordFlower may terminate immediately for material breach (including non-payment or illegal use), or with 30 days' notice for any other reason. Where termination is not due to your breach, RecordFlower will provide a pro-rata refund of prepaid fees for the unused portion of the billing period.
RecordFlower's total liability for any claim shall not exceed the subscription fees paid in the three (3) months preceding the event. RecordFlower shall not be liable for indirect, incidental, or consequential damages; loss of profits, revenue, or data; claims arising from seller-customer transactions; Discogs API failures; or payment provider failures. These limitations apply regardless of legal theory.
The Service is provided "as is" and "as available". RecordFlower makes no warranty that the Service will be uninterrupted or error-free, or that Discogs-sourced data will be accurate or complete.
For material changes, RecordFlower will provide at least 30 days' written notice by email. Continued use after the effective date constitutes acceptance.
These Terms are governed by the laws of the Netherlands. Disputes shall be submitted to the competent court in the Netherlands.

Lees deze algemene voorwaarden ("Voorwaarden") zorgvuldig voordat u het RecordFlower-platform op https://recordflower.com (de "Dienst") gebruikt, geëxploiteerd door RecordFlower V.O.F. ("RecordFlower", "wij", "ons" of "onze").
Door een account aan te maken en de Dienst te gebruiken, gaat u ("de Verkoper") akkoord met deze Voorwaarden. De Dienst is uitsluitend bestemd voor zakelijke gebruikers — personen en bedrijven die handelen in de uitoefening van hun beroep of bedrijf.
RecordFlower is een technisch platform waarmee Discogs-verkopers een eigen webshop kunnen bouwen en beheren op basis van hun Discogs-inventaris. RecordFlower levert de software-infrastructuur: storefronthosting, Discogs-inventarissynchronisatie, checkout en orderbeheer.
RecordFlower is uitsluitend een technische dienstverlener. RecordFlower is geen partij bij een koopovereenkomst tussen de Verkoper en diens eindklanten. Alle productaanbiedingen, verkopen, uitvoering, betalingen, retourzendingen en klantrelaties vallen uitsluitend onder de verantwoordelijkheid van de Verkoper. RecordFlower aanvaardt geen verantwoordelijkheid of aansprakelijkheid voor transacties via de webshop van een Verkoper.
U garandeert dat alle door u verstrekte informatie juist en volledig is. U bent verantwoordelijk voor de vertrouwelijkheid van uw inloggegevens en voor alle activiteiten die plaatsvinden via uw account. Meld mogelijke onbevoegde toegang direct bij ons via [email protected]. U moet minimaal 18 jaar oud zijn en bevoegd zijn om rechtsgeldige overeenkomsten aan te gaan.
De Dienst koppelt aan uw Discogs-account via OAuth 1.0a. Door deze koppeling te autoriseren, geeft u RecordFlower toestemming om namens u toegang te krijgen tot uw Discogs-inventaris, aanbiedingen en gerelateerde gegevens. U blijft de accounthouder en de partij die gebonden is aan de API-gebruiksvoorwaarden van Discogs ("Discogs-voorwaarden") voor alle API-gebruik via RecordFlower.
3.1 — Uw Discogs-account en naleving
U garandeert dat: (a) u houder bent van een geldig, actief Discogs-account in goede staat; (b) u de Discogs-voorwaarden en alle Discogs-beleidsregels heeft geaccepteerd en zult blijven naleven; en (c) uw gebruik van de RecordFlower-dienst niet leidt tot een schending van Discogs-beleid door RecordFlower of uzelf. U bent als enige verantwoordelijk voor uw Discogs-account, de inloggegevens en alle via de Dienst uitgevoerde activiteiten.
Als Discogs uw account of API-toegang — om welke reden dan ook, inclusief een schending van de Discogs-voorwaarden — schorst, beperkt of beëindigt, mag RecordFlower uw toegang tot alle Discogs-afhankelijke functies van de Dienst onmiddellijk opschorten. RecordFlower aanvaardt geen enkele verantwoordelijkheid of aansprakelijkheid voor de gevolgen van een dergelijke schorsing of beëindiging door Discogs, waaronder maar niet beperkt tot: verlies van storefrontbeschikbaarheid, verlies van inventarisgegevens, omzetderving, reputatieschade of enig ander direct of indirect verlies voor u of uw klanten. Een dergelijke opschorting door RecordFlower vormt geen tekortkoming in de nakoming van deze Voorwaarden en geeft geen recht op terugbetaling, vergoeding of schadevergoeding.
3.2 — Reikwijdte van gegevenstoegang
RecordFlower heeft alleen toegang tot de Discogs-gegevens die noodzakelijk zijn voor de Dienst: uw aanbiedingen, catalogusgegevens en beschikbaarheidsstatus. RecordFlower treedt uitsluitend op als technische agent die namens u API-verzoeken uitvoert. RecordFlower draagt uw Discogs-gegevens niet over aan derden, tenzij dit noodzakelijk is om deze in uw eigen storefront te tonen.
3.3 — Verplichte Discogs-naamsvermelding
De Discogs-voorwaarden vereisen dat de volgende meldingen worden weergegeven in elke toepassing die de Discogs API gebruikt. RecordFlower plaatst deze meldingen op storefrontpagina's die Discogs-gegevens tonen. U mag uw storefront niet zodanig configureren dat deze verplichte vermeldingen worden verwijderd of verborgen:
3.4 — Actualiteit van gegevens
De Discogs-voorwaarden verbieden het tonen van gegevens die meer dan zes (6) uur ouder zijn dan de informatie op de Discogs-website. U bent verantwoordelijk voor het instellen van een synchronisatieschema dat frequent genoeg is om aan deze eis te voldoen. RecordFlower aanvaardt geen aansprakelijkheid voor niet-naleving als gevolg van een te laag ingestelde synchronisatiefrequentie of onbeschikbaarheid van de Discogs API.
3.5 — Beschikbaarheid van de API en beëindiging door Discogs
Discogs kan de toegang tot zijn API op elk moment en zonder voorafgaande kennisgeving wijzigen, beperken of beëindigen. RecordFlower heeft geen controle over en aanvaardt geen aansprakelijkheid voor onderbreking, verslechtering of beëindiging van de Discogs API-toegang, inclusief de gevolgen daarvan voor de beschikbaarheid van uw storefront, inventarisgegevens of omzet. Een dergelijke opschorting vormt geen tekortkoming door RecordFlower en geeft geen recht op terugbetaling, tenzij zulks op grond van dwingend recht vereist is.
3.6 — Geen banden met Discogs
RecordFlower V.O.F. is een onafhankelijke softwareleverancier. RecordFlower is niet gelieerd aan, gesponsord door, onderschreven door of op enigerlei andere wijze officieel verbonden met Zink Media, LLC (h.o.d.n. Discogs). "Discogs" is een geregistreerd handelsmerk van Zink Media, LLC.
3.7 — Vrijwaring bij schending van de Discogs-voorwaarden
U vrijwaart RecordFlower V.O.F. en haar leden, medewerkers en vertegenwoordigers voor alle aanspraken, vorderingen, verliezen, aansprakelijkheden en kosten (inclusief redelijke juridische kosten) die voortvloeien uit: (a) uw schending van de Discogs-voorwaarden of enig Discogs-beleid; (b) een vordering van Discogs jegens RecordFlower als gevolg van uw gebruik van de Dienst; of (c) misbruik van Discogs-gegevens die via uw account en de Dienst zijn verkregen.
Toegang tot de Dienst wordt verleend op abonnementsbasis, vooraf gefactureerd op maandelijkse of jaarlijkse basis. Uw abonnement verlengt automatisch tenzij u vóór de verlengingsdatum opzegt. U machtigt RecordFlower om de toepasselijke kosten in rekening te brengen op uw betalingsmethode. Bij mislukte betaling dient u dit binnen 14 dagen te herstellen. Opzegging is op elk moment mogelijk via het dashboard; gedeeltelijke terugbetaling van ongebruikte tijd wordt niet verleend, tenzij dit wettelijk vereist is.
RecordFlower kan een gratis proefperiode aanbieden. Als u niet opzegt vóór het einde van de proefperiode, worden de toepasselijke abonnementskosten in rekening gebracht. RecordFlower behoudt zich het recht voor om gratis proefaanbiedingen op elk moment te wijzigen of in te trekken.
RecordFlower stelt u ten minste 30 dagen van tevoren schriftelijk (per e-mail) op de hoogte van tariefwijzigingen. Voortgezet gebruik na de ingangsdatum geldt als aanvaarding van de gewijzigde tarieven.
Als Verkoper bent u als enige verantwoordelijk voor:
U stemt ermee in de Dienst niet te gebruiken voor het aanbieden of verkopen van namaak, gestolen of illegale goederen, het plegen van fraude, het reverse-engineeren of verstoren van het platform, of het overtreden van toepasselijke wet- en regelgeving. RecordFlower behoudt zich het recht voor om accounts die betrokken zijn bij misbruik of illegale activiteiten te schorsen of te beëindigen.
De Dienst en de software, het ontwerp en de huisstijl zijn eigendom van RecordFlower V.O.F. en haar licentiegevers, beschermd door Nederlands en Europees intellectueel-eigendomsrecht. U krijgt een beperkte, niet-exclusieve, niet-overdraagbare licentie om de Dienst te gebruiken voor de exploitatie van uw webshop. Door u geüploade inhoud blijft uw eigendom; u verleent RecordFlower een beperkte licentie om deze te hosten en weer te geven ter verlening van de Dienst.
Beide partijen kunnen deze Voorwaarden op elk moment beëindigen. RecordFlower kan uw account onmiddellijk beëindigen bij een wezenlijke tekortkoming (inclusief wanbetaling of illegaal gebruik), of met een opzegtermijn van 30 dagen om andere redenen. Indien de beëindiging niet het gevolg is van uw tekortkoming, zal RecordFlower vooruitbetaalde abonnementskosten naar rato terugbetalen voor de ongebruikte periode.
De totale aansprakelijkheid van RecordFlower voor een vordering is beperkt tot de abonnementskosten die u in de drie (3) maanden voorafgaand aan het schadeveroorzakende event heeft betaald. RecordFlower is niet aansprakelijk voor indirecte, incidentele of gevolgschade; omzetderving of gegevensverlies; vorderingen voortvloeiend uit transacties tussen verkoper en eindklant; storingen in de Discogs API; of betalingsproblemen bij betalingsproviders.
De Dienst wordt geleverd "zoals deze is" en "zoals beschikbaar". RecordFlower geeft geen garantie dat de Dienst ononderbroken of foutloos zal functioneren, of dat via Discogs verkregen gegevens juist of volledig zijn.
Bij wezenlijke wijzigingen stelt RecordFlower u ten minste 30 dagen van tevoren schriftelijk op de hoogte per e-mail. Voortgezet gebruik na de ingangsdatum geldt als aanvaarding.
Op deze Voorwaarden is Nederlands recht van toepassing. Geschillen worden voorgelegd aan de bevoegde rechter in Nederland.
